The information provided through the Services is not intended for distribution to or use by any person or entity in any jurisdiction where such use would be contrary to law or subject us to registration requirements. Those who access the Services from other locations do so on their own initiative and are responsible for compliance with local laws.

We own or license all intellectual property rights in the Services, including source code, databases, functionality, software, designs, audio, video, text, photographs, graphics (the “Content”), and the trademarks, service marks, and logos (the “Marks”). The Content and Marks are provided “AS IS” for your personal, non-commercial use or internal business purpose only.

We grant you a non-exclusive, non-transferable, revocable license to access the Services and download or print a copy of Content you have properly accessed, solely for personal or internal business use. By using the Services, you represent and warrant that:

• You have the legal capacity and agree to comply with these Legal Terms.
• You are not a minor in your jurisdiction, or you have received parental permission to use the Services.
• You will not access the Services through automated or non-human means.
• You will not use the Services for any illegal or unauthorized purpose.
• Your use will not violate any applicable law or regulation.

If you provide untrue, inaccurate, or incomplete information, we may suspend or terminate your account and refuse current or future use of the Services.

We make every effort to display the colors, features, specifications, and details of products as accurately as possible, but we do not guarantee that they will be accurate, complete, or error-free, and your display may not accurately reflect actual details. All products are subject to availability. Vehicle and equipment availability, pricing, and specifications are subject to change without notice, and we reserve the right to discontinue any product at any time.

You agree to provide current, complete, and accurate purchase and account information, and to promptly update it. Sales tax will be added where required. All payments are in US dollars. You authorize us to charge your payment provider for your orders plus applicable fees. We reserve the right to correct pricing errors, refuse or limit any order, and to limit or prohibit orders that appear to be placed by dealers, resellers, or distributors. Payment card processing is handled by Stripe, subject to Stripe's terms and privacy practices.

By providing your mobile phone number and opting in, you consent to receive text messages (SMS/MMS) from Western Truck & Trailer Sales Inc.. Your consent to receive text messages is not a condition of any purchase.

Your mobile information is protected

Mobile information (phone numbers and SMS opt-in data) will not be shared with third parties or affiliates for marketing or promotional purposes.

Program description

When you opt in, you may receive messages related to inquiries, price quotes, orders, parts and service updates, appointment and delivery reminders, account notifications, customer care, and — where you have opted in — sales and promotional offers.

Frequency, rates, opt-out, and help

• Message frequency varies based on your activity and preferences.
• Message and data rates may apply according to your carrier's plan; we are not responsible for carrier charges.
• Cancel anytime by replying STOP; you will receive a one-time confirmation and no further messages unless you opt in again.

• Carriers are not liable for delayed or undelivered messages.

• Circumvent, disable, or interfere with security-related features of the Services.
• Use the Services to harass, abuse, or harm another person, or to disparage or harm us.
• Upload viruses or material that interferes with the Services, or engage in automated use, data mining, or scraping.
• Decompile, disassemble, or reverse engineer any software comprising the Services.
• Use the Services to advertise or sell goods, or to compete with us.

The Services may invite you to post content (“Contributions”). Any Contributions you transmit may be treated as non-confidential and non-proprietary, and you represent that they do not violate any third party's rights and are not false, obscene, harassing, or otherwise objectionable.

By posting Contributions, you grant us an unrestricted, irrevocable, perpetual, non-exclusive, transferable, royalty-free, worldwide license to host, use, copy, reproduce, publish, broadcast, store, and distribute them for any purpose. We do not assert ownership over your Contributions; you retain all ownership and associated intellectual property rights.

The Services may contain links to third-party websites and content that we do not investigate, monitor, or check for accuracy. We are not responsible for them, and their inclusion does not imply endorsement. If you access third-party websites or content, you do so at your own risk, and these Legal Terms no longer govern.

We reserve the right, but not the obligation, to monitor the Services for violations, take legal action against violators, refuse or restrict access to or disable Contributions, remove burdensome files or content, and otherwise manage the Services to protect our rights and ensure proper functioning.

We care about data privacy and security. Please review our Privacy Policy, which is incorporated into these Legal Terms. The Services are hosted in the United States; by using them you consent to having your data transferred to and processed in the United States.

These Legal Terms remain in full force while you use the Services. We reserve the right, in our sole discretion and without notice or liability, to deny access to and use of the Services to any person for any reason, including for breach of these Legal Terms or applicable law. We may terminate your use or delete content you posted at any time, without warning.

We reserve the right to change, modify, or remove the contents of the Services at any time without notice, and we have no obligation to update information. We cannot guarantee the Services will be available at all times and may experience interruptions, delays, or errors. We are not liable for any loss, damage, or inconvenience caused by your inability to access or use the Services during any downtime or discontinuance.

These Legal Terms and your use of the Services are governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict-of-law principles.

Any legal action will be commenced in the state and federal courts located in Salt Lake County, Utah, and the parties consent to jurisdiction and venue there. The parties agree to first attempt to resolve any dispute informally for at least thirty (30) days before initiating litigation.

There may be information on the Services that contains typographical errors, inaccuracies, or omissions relating to descriptions, pricing, and availability. We reserve the right to correct any errors and to change or update information at any time without prior notice.

THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTIES ABOUT THE ACCURACY OR COMPLETENESS OF THE SERVICES' CONTENT OR ANY LINKED WEBSITES.

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT OR LOST REVENUE, ARISING FROM YOUR USE OF THE SERVICES. OUR LIABILITY WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US.

You agree to defend, indemnify, and hold us harmless — including our subsidiaries, affiliates, officers, agents, partners, and employees — from any loss, damage, liability, claim, or demand, including reasonable attorneys' fees, arising out of your use of the Services, your breach of these Legal Terms, your breach of your representations and warranties, or your violation of a third party's rights.

We maintain certain data you transmit to manage the performance of the Services. Although we perform routine backups, you are solely responsible for all data you transmit. We have no liability to you for any loss or corruption of such data, and you waive any right of action against us arising from it.

Visiting the Services, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications and agree that all agreements, notices, and disclosures we provide electronically satisfy any legal requirement that they be in writing.
